FREMP
> Project Review
BIEAP and FREMP use a two-track process to review projects in Burrard Inlet and the Fraser River Estuary. Track 1 projects (of a predictable nature with little or no impact) are dealt with by the Lead Agencies (i.e. Port Authorities). Track 2 projects (projects of a more complex nature with potential impacts) are reviewed by the BIEAP and FREMP environmental review committees. Projects subject to both BCEAA and CEAA are reviewed outside of BIEAP and FREMP under a separate harmonized review process.
Projects that do not fall into the Track 1, Track 2 or BCEAA/CEAA harmonized review processes will be discussed and an appropriate review path will be decided on by the Environmental Review Committee or the Management Committee where it is beyond the scope of the environmental review committees.
A key component of the FREMP partnership's efforts to coordinate
the environmental management of the Fraser River estuary, is the
review of proposals for shoreline development and other activities
in these marine ecosystems.
Known as the Coordinated Project Review
Process, the partners collectively review proposals before a
federal, provincial or municipal authority makes any decision that
would allow the project to proceed. There is a three-phase, two-track
process for project review.
It is important to note that the coordinated project review process
does not issue project approvals. Instead, it provides the responsible
authorities and the proponent with mitigation recommendations prior
to making a decision about approving the project. Track
2 reviews (the most commonly reviewed by the FREMP ERC) are usually
completed within a 30-business daytime frame, depending on the complexity
of the project.
Three Phase Process
The Coordinated Project Review process is comprised of the following
three phases:
- Pre-review;
- Review,
and;
- Post-review.
Phase 1 - Pre-review
The pre-review phase results in a determination as to which of four
tracks will be used for the review phase.
Phase 2 -
Review using a Four Track Process
Track
1 reviews apply to proposals where perational guidelines or
best management practices are already in place and where adverse
impacts are unlikely and valuable habitat is not at risk. Port Authorities
generally handle Track 1 reviews.
Track
2 reviews are those carried out by the environmental review
committees for FREMP. They typically take under 30-businees days
to review, but may take longer due to the complexity of a project.
There
are three possible decisions that can be made following the
review phase:
1. With appropriate mitigation measures, the project is not likely
to cause significant adverse effects, and the project can proceed.
(known as a 'Letter of Recommendations/Project Review'.)
2. The project can be referred to a review panel or a mediator because,
even with mitigation measures, the project may still have adverse
effects or the project may be justifiable despite adverse effects
or there are serious public concerns about the project.
3. The project cannot proceed because it is likely that mitigation
measures will not prevent significant adverse effects that cannot
be justified. (Known as a 'Letter
of Rejection'.)
Phase 3 - Post Review
The post-review phase includes provisions for monitoring and follow-up
on the implementation of mitigation recommendations in projects
reviewed though the coordinated process.
