Canada Environmental Assessment Act

During the last decade, Canadians have become increasingly aware of the importance of maintaining both a strong economy and a healthy environment. In January 1995 the Canadian Environmental Assessment Act (CEAA) was proclaimed. After nationwide consultations and a comprehensive review, the Minister of Environment tabled a bill to amend the Act on March 20, 2001.

CEAA sets out in legislation responsibilities and procedures for the environmental assessment of projects involving the federal government. CEAA establishes a clear and balanced process that brings a degree of certainty to the environmental assessment process and helps responsible authorities (RAs) determine the environmental effects of projects early in their planning stage.

Environmental assessment provides a systematic approach for identifying the environmental effects of proposed projects. By identifying adverse environmental effects before they occur, environmental assessment allows decision-makers to modify plans so that the effects can be minimized or eliminated.

CEAA applies to projects for which the federal government holds decision-making authority -- whether as proponent, land administrator, source of funding, or regulator.

CEAA has four stated objectives:

1. To ensure that the environmental effects of projects receive careful consideration before responsible authorities take action.

2. To encourage responsible authorities to take actions that promote sustainable development, thereby achieving or maintaining a healthy environment and a healthy economy.

3. To ensure that projects to be carried out in Canada or on federal lands do not cause significant adverse environmental effects outside the jurisdictions in which the projects are carried out.

4. To ensure that there be an opportunity for public participation in the environmental assessment process.
